Paternity

Paternity means obtaining a court order or legal determination of who the legal parents of a child are. If the parents of a child were not married when the child was born, the child does not have a legal father until parentage or paternity is established. Even if a father can prove he is the biological father of a child, if he was never married to the mother, he does not legally have any rights or responsibilities for that child until paternity is legally established. Once paternity is established, the parents will need to determine custody, visitation (parenting time), and child support.

There are many advantages for both the child and parents in establishing paternity. It provides the child with the emotional benefit of knowing who his/her biological father is. It also provides the child with the same legal rights as a child of married parents such as:
  • Both parents’ names are on the birth certificate
  • Financial support from both parents
  • Health and life insurance
  • Government benefits such as Social Security and Veteran’s benefits if eligible
  • Access to the medical history of both parents
  • Inheritance rights
