Premarital Agreement

A premarital agreement, often referred to as a prenuptial agreement or “prenup,” is a legal document between a couple before they are married that defines their respective rights and responsibilities during their marriage as well as if their marriage ends in legal separation or divorce. A premarital agreement may address the division of asset and debts, appreciation or gains on assets or property, income during the marriage, and spousal support.

A premarital agreement is not limited to the wealthy. Anybody contemplating marriage that owns a home, has a pension or other assets, earns significantly more than the other party, or wants to preserve income or assets for their children should consider a premarital agreement.

California family law allows parties to enter into premarital agreements, provided certain statutory requirements are met. A premarital agreement will reduce and/or avoid divorce litigation, which can be time consuming and expensive while allowing the parties, not the court, to decide the terms of a divorce. CMS’ Riverside, California prenup lawyer, Laura Rosauer, is experienced in helping couples decide what terms should be included in their premarital agreement. With the help of a prenup mediator, a couple has a greater chance at coming up with a premarital agreement that works for both of them.
